Cognitive integration is a defining yet overlooked feature of our intellect that may nevertheless have substantial effects on the process of knowledge-acquisition. To bring those effects to the fore, I explore the topic of cognitive integration both from the perspective of virtue reliabilism within externalist epistemology and the perspective of extended cognition within externalist philosophy of mind and cognitive science. On the basis of this interdisciplinary focus, I argue that cognitive integration can provide a minimalist yet adequate epistemic norm of (...) subjective justification: so long as the agent’s belief-forming process has been integrated in his cognitive character, the agent can be justified in holding the resulting beliefs merely by lacking any doubts there was something wrong in the way he arrived at them. Moreover, since both externalist philosophy of mind and externalist epistemology treat the process of cognitive integration in the same way, we can claim that epistemic cognitive characters may extend beyond our organismic cognitive capacities to the artifacts we employ or even to other agents we interact with. This move is not only necessary for accounting for advanced cases of knowledge that is the product of the operation of epistemic artifacts or the interactive activity of research teams, but it can further lead to interesting ramifications both for social epistemology and philosophy of science. While nudging has garnered plenty of interdisciplinary attention, the ethics of applying it to climate policy has been little discussed. However, not all ethical considerations surrounding nudging are straightforward to apply to climate nudges. In this article, we overview the state of the debate on the ethics of nudging and highlight themes that are either specific to or particularly important for climate nudges. These include: the justification of nudges that are not self-regarding; how to account for climate change denialists; transparency; (...) knowing the right or best behaviours; justice concerns; and whether the efficacy of nudges is sufficient for nudges to be justified as a response to the climate crisis. We conclude that climate nudges raise distinct ethical questions that ought to be considered in developing climate nudges. (shrink)

This chapter is particularly concerned with the status of history, dance history especially, within Dance Studies. It asks what has befallen the more recent status of history, once an epistemological support at a critical stage in Dance Studies’s early development, now that Dance Studies is better established, relatively speaking, within the academy. Is history so much scaffolding which, having fulfilled its purpose in enabling the disciplinary plant to take root, is to be dismantled and, if not actually discarded, at least (...) demoted? Three factors will be identified and proposed as having particular significance in this connection, imbuing this chapter with a tri-partite structure. The first concerns the already noted strong imprint of Cultural Studies on Dance Studies and the possible bearing of this imprint on dance history’s status within Dance Studies. For the particular manner in which Dance Studies has construed Cultural Studies may, this chapter will suggest, have impacted upon dance history’s standing within communities of dance scholarship. The second factor has to do with the implications, for dance history, of a particular critique based in a branch of dance scholarship, that perceives phenomenology, which it deems a good fit for dance inquiry, as inherently antithetical to history. In particular, this critique takes the work of Michel Foucault - which it identifies closely with, and as, historical practice - as incompatible with dance enquiry. Incompatibility is staked on the twin grounds of Foucault’s break with, and supposed resulting and enduring antipathy towards, phenomenology; and his perceived embrace of history which is, itself, also understood to result from such a break. In effect, then, this critique questions the very suitability, for dance research, of approaches based in history-focussed inquiry. The ability to call this critique into question, in the ways that the present discussion, in seeking to rehabilitate Foucault, and so history, needs to demonstrate, constitutes the third factor. This final factor makes two particular, further demands of this chapter. Namely that the interrelated questions of Foucault, phenomenology, and dance; and of the position which phenomenology has itself adopted in relation to history, be re-visited and re-evaluated to the extent that space reasonably allows. Fortunately, these interrelated questions are ones which have - relatively recently - preoccupied scholarship on Foucault, and on phenomenology, respectively. This preoccupation may in and of itself be one possible indicator that there is indeed more at stake, and so to consider, regarding both questions, than the lines drawn by the aforementioned critique might suggest. The hope of finding new methods of predicting the course of historical processes could be connected with the recent developments of the theory of self-organisation, also called synergetics. It provides us with knowledge of constructive principles of co-evolution of complex social systems, co-evolution of countries and geopolitical regions being at different stages of development, integration of the East and the West, the North and the South. Due to the growth of population on the Earth in blow-up regime, the general and (...) local instability of development is increasing. The social world seems to go towards a unity, a sustainable commonwealth through pulsations rather than monotonously. It goes via alternation of disintegration, even if partial, and getting more powerful integrations of structures. There is a path of multiple reduction of temporal and material expenses, a path of a resonant excitation of desirable and — no less important — feasible in a given social system structure. Main principles of the complex nonlinear thinking which are based on the notions of the modern theory of evolution and self-organization of complex systems called also synergetics are under discussion in this article. The investigation of the mutual complementarity of anthropological and ontological paradigms under these circumstances is the main purpose of present publication. The comparative conceptual analysis of the bio-power and bio-politics in the mentality of the modern technological civilization is a main method of the research. The methodological and philosophical analogy of biological and social engineering allows combining them in the nature and social implications (...) as part of a High Hume technologies class. As result of the transformation of somatic foundations of the human being and his behavior, stereotypes in the object of control and management the technogenic risk reached the existential level. Today a change is imperative in approaching global problems: what is needed is not arm-twisting and power politics, but searching for ways of co-evolution in the complex social and geopolitical systems of the world. The modern theory of self-organization of complex systems provides us with an understanding of the possible forms of coexistence of heterogeneous social and geopolitical structures at different stages of development regarding the different paths of their sustainable co-evolutionary development. The theory argues that the evolutionary channel to (...) the observed increasing complexity is extremely narrow and only certain discrete spectra of relatively stable self-maintained structures are feasible in complex systems. There exists a restricted set of ways of assembling a complex evolutionary whole from diverse parts. The law of nonlinear synthesis of complex structures reads: the integration of structures in more complex ones occurs due to the establishment of a common tempo of their evolution. On the basis of the theory, we can see not only desirable but also attainable futures. (shrink)

Internalist approaches to epistemic justification are, though controversial, considered a live option in contemporary epistemology. Accordingly, if ‘active’ externalist approaches in the philosophy of mind—e.g. the extended cognition and extended mind theses—are _in principle_ incompatible with internalist approaches to justification in epistemology, then this will be an epistemological strike against, at least the _prima facie_ appeal of, active externalism. It is shown here however that, contrary to pretheoretical intuitions, neither the extended cognition _nor_ the extended mind theses are in principle (...) incompatible with two prominent versions of epistemic internalism—viz., accessibilism and mentalism. In fact, one possible diagnosis is that pretheoretical intuitions regarding the incompatibility of active externalism with epistemic internalism are symptomatic of a tacit yet incorrect identification of epistemic internalism with epistemic individualism. Thus, active externalism is not in principle incompatible with epistemic internalism per se and does not significantly restrict one’s options in epistemology. (shrink)

Philosophy of mind and cognitive science (e.g., Clark and Chalmers 1998; Clark 2010; Palermos 2014) have recently become increasingly receptive tothe hypothesis of extended cognition, according to which external artifacts such as our laptops and smartphones can—under appropriate circumstances—feature as material realisers of a person’s cognitive processes. We argue that, to the extent that the hypothesis of extended cognition is correct, our legal and ethical theorising and practice must be updated, by broadening our conception of personal assault so as to (...) include intentional harm towards gadgets that have been appropriately integrated. The heuristic value of synergetic models of evolving and self-organizing complex systems as well as their application to epistemological problems is shown in this paper. Nonlinear synergetic models turn out to be fruitful in comprehending epistemological problems such as the nature of human creativity, the functioning of human intuition and imagination, the historical development of science and culture. In the light of synergetics creative thinking can be viewed as a selforganization and self-completion of images and thoughts, filling up gaps in (...) the nets of knowledge. Insight, fast and sudden solutions of scientific problems, instabilities when “an idea is in the air” are considered as examples of blow-up regimes in the cognitive field. (shrink)

Online education has become an essential component of education. Thus, several factors, such as the student’s learning strategy and motivation, generally contribute to their academic success. This study investigates the relationship between learning strategies, motivation, and online learning environment among 150 first-year college students. Employing correlational design, the statistical findings of the study reveal that the r coefficient of 0.59 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision (...) to reject the null hypothesis. In 2020, the European Union announced the award of the contract for the biometric part of the new database for border control, the Entry Exit System, to two companies: IDEMIA and Sopra Steria. Both companies had been previously involved in the development of databases for border and migration management. While there has been a growing amount of publicly available documents that show what kind of technologies are being implemented, for how much money, and by whom, there has been limited engagement (...) with digital methods in this field. Moreover, critical border and security scholarship has largely focused on qualitative and ethnographic methods. Building on a data feminist approach, we propose a transdisciplinary methodology that goes beyond binaries of qualitative/quantitative and opacity/transparency, examines power asymmetries and makes the labour of coding visible. Empirically, we build and analyse a dataset of the contracts awarded by two European Union agencies key to its border management policies – the European Agency for Large-Scale Information Systems (eu-LISA) and the European Border and Coast Guard Agency (Frontex). We supplement the digital analysis and visualisation of networks of companies with close reading of tender documents. In so doing, we show how a transdisciplinary methodology can be a device for making datafication ‘intelligible’ at the European Union borders. (shrink)

If global distributive justice or injustice is to exist, there must be something that is just or unjust: something to which the moral assessments at issue attach. I argue in this paper against one popular candidate for that role: the “global basic structure.” I argue that principles of distributive justice that target the global basic structure fail to satisfy a crucial “action guidance” desideratum and that this problem points to an alternative target that philosophers of global justice have yet to (...) widely acknowledge. Through a comparative approach to both artists' poetics, an understanding is created that love is not a simplistic action and all the words read in or applied to their visual discourse must be considered within a wide range of love in visual and literary images. Two arguments against the compatibility of epistemic internalism and content externalism are considered. Both arguments are shown to fail, because they equivocate on the concept of justification involved in their premises. To spell out the involved equivocation, a distinction between subjective and objective justification is introduced, which can also be independently motivated on the basis of a wide range of thought experiments to be found in the mainstream literature on epistemology. The subjective/objective justification distinction is also ideally suited for providing (...) new insights with respect to central issues within epistemology, including the internalism/externalism debate and the New Evil Demon intuition. This article analyzes the evolution of aesthetic role of the nature in the Middle Ages from the point of view of the philosophical systems influence on the interpretation of the corporal as a legitim way to the knowledge of the truth. it studies the intimate approach of neo-platonism, the shaping of its premises in the rejection of physical beauty and the change that occured after the assimilation of Aristotelianism toward a naturalistic outsourcing of the intellectual and artistic interests.

This article analyzes the treatment of natural philosophy in the work of Thomas Aquinas from the point of view of assimilation of the Aristotelian physical corpus. It focuses primarily on the Aquinas’s defense of the conception of the fallibility of the natural reason, the provisional and revisable character of all physical theories, the necessity of intercultural dialogue to discover the truths about nature, and Aquinas’s role in the development of the skeptical attitude in scientific research of the mobile’s world.

This study aimed to determine the effectiveness of using Team Assisted Individualization (TAI) as cooperative learning teaching approach to improve students’ mathematical cognition. A quantitative research design via experimental design using one group pretest and post-test was employed. This only concentrated on specific students’ processing speed and working memory and included 67 grade 9 students from a public school in the Philippines. The findings showed that the components of TAI were moderately effective under the placement test, effective under the teams, (...) teaching group, student creative, team study, fact test and team score than whole class and highly effective under team recognition, Furthermore, there is a significant difference between the pre-test and post-test scores in each completed stage, and TAI approach is an effective strategy in improving the mathematical cognition of students. This study argues that TAI approach may be utilized in mathematics classrooms to improve the mathematical cognition of students. The gravity of the lessons or topics may be put into consideration to balance the learning and performances of students. (shrink)

Nesta comunicação pretende-se desenvolver a relação entre violência e política enquadrada no pensamento de Hannah Arendt e a partir de duas obras fundamentais, On Revolution (1963) e On Violence (1970). Investigando-se sobre o que constitui cada experiência em particular, a da violência (ainda que sob a forma da guerra ou da revolução) e a da política, esta relação permitirá equacionar criticamente as possibilidades e os limites das sociedades democráticas actuais como o resultado da tradição política e das revoluções da modernidade.

This article intends to analyze the performance and the efficiency of companies and to identify the key factors that may explain it. It was selected a sample with 15 enterprises: 7 Portuguese and 8 Ukrainian ones, belonging to several industries. Financial and non-financial data was collected for 6 years, during the period of 2009 to 2014. Research questions that guided this work were: Are the enterprises efficient/profitable? What factors influence enterprises’ efficiency/performance? Is there any difference between Ukrainian and Portuguese enterprises’ (...) efficiency/performance, which factors have more influence? Which industrial sector is represented by more efficient/profitable enterprises? The main results showed that in average enterprises were efficient with low level of profitability. According to gained results several indicators were highlighted so that companies would pay more attention to them. (shrink)

A bioética se dedica a esse debate e se propõe a estendê-lo a setores não acadêmicos, como sociedades de proteção dos animais, dos direitos humanos e até grupos religiosos. Essa diversidade de opiniões não só é interessante, mas necessária, uma vez que (...) os valores praticados em uma sociedade provêm de uma construção social cujos blocos fundamentais têm origem na família e nos diversos grupos sociais nos quais os indivíduos estão inseridos desde o seu nascimento. A proposta deste livro é fomentar esse debate, fornecendo conceitos e visões sobre temas selecionados da pesquisa e da prática médica, biotecnológica e de áreas correlatas. Em um contexto mundial de intolerância política, social, étnica e de gênero, oportunidades de debate também possuem um papel social de auxiliar no desenvolvimento consciente da cidadania e do respeito ao próximo. This study aims at assessing the meaning and the extent of the possible relationship between philosophy and literature in and from two significant contemporary thinkers, Maurice Blanchot and Paul Ricoeur. -/- Based on the assumption that both represent the human effort of touching and configuring an essential bottom which seems to escape an immediate seizure – although it is generally considered that philosophy does it through the conceptual/critical discourse and literature through the metaphorical/poetic discourse – the key problem we wish (...) to answer is to know, in that attempt, whether the mentioned activities can or must come close, especially the first in relation to the second. Such problem inevitably disseminates itself in a set of questions which we propose ourselves to think by having the mentioned authors as a starting point: can literature, in its specificity, open new possibilities of expression or mediation of a being or a neuter which precedes us and, therefore, assume itself as a privileged locus for (the calling for) philosophical reflection? Is it philosophically desirable, or even inevitable, a proximity to literature? Or, more radically, is the defense of a clear separation between philosophy and literature sustainable? In that sense, the essay is divided in three moments: in the first, we clarify the conceptions of the language, of the written text and of the relation author-work-reader from which the authors go from; in the second, we intend to think about how the poetic text opens new possibilities of expression or mediation due to its own world and devices; lastly, we will assess more thoruoghly the meaning and the extent that the relation philosophy-literature acquires in each of the proposals. -/- Although they share a few assumptions, our authors’ perspectives will display different concerns or impulses – one we shall call retrospective and another we shall call prospective – which will lead us to different answers. Giere’s analysis of the epistemic role of fiction in science and literature is the representative of antifictionists. Our research finds the three inconsistencies in his main paper regarding the comparison of fiction in scientific models and literary works. We analyze his argument and offer our solution to the issue favoring the perspective of fictionalism. Further, we support a typological differentiation of false representation in science into fictional and fictitious. The value of this differentiation we demonstrate by giving the example of (...) digital organisms in system biology. The paper aims to help better understanding of fiction in science and to avoid the oversimplification of literary fiction. (shrink)

This essay presents Husserl’s Formal and Transcendental Logic (1929) in three main sections following the layout of the work itself. The first section focuses on Husserl’s introduction where he explains the method and the aim of the essay. The method used in FTL is radical Besinnung and with it an intentional explication of proper sense of formal logic is sought for. The second section is on formal logic. The third section focuses on Husserl’s “transcendental logic,” which is needed to make (...) Husserl’s conception complete, i.e., to understand what makes Besinnung radical, how the proper sense of formal logic has been reached and how all this relates to transcendental constitution of an object in the world. Husserl’s work is connected to his context (in exact sciences) and the relevance of his views for the contemporary approaches is discussed. (shrink)

The structuralist reconstruction of the metabolic biochemistry here presented is a more complete and revised version than the one presented in Donolo, Federico & Lorenzano (2006). This version, as the previous one, continues with the reconstructive task initiated by César Lorenzano (2002), but advances further on those elements which remained pendent of reconstruction: applications subsequent to the paradigmatic one, for being these “too diversified and numerous” (p. 210).In line with which is said before, the objective of this new reconstruction is (...) to make the theoretical network of the biochemistry wider, in order to be able to capture the many successful applications (paradigmatic examples or exemplars) which appear in modern university textbooks. In order to accomplish this, major conceptual precisions are being introduced which will have repercussions in a modification and increased complexity of the fundamental law implicit in the text books, but still conserving the previous basic idea. Because of all this we can say that the present article goes further into the reconstruction task of the metabolic biochemistry theory. (shrink)

The purpose of this paper is to contextualize the study of metaphors within constructivist-informed research, in the hope that this process will orient cognitive scientists to the usefulness of implementing qualitative research methodologies, especially to using the person of the researcher as the primary research instrument. First, I explore some of the differences between Johnson and Lakoff’s Contemporary Metaphor Theory (CMT) and approaches evolving from it on one hand, and the clinical approach to metaphor based on a constructivist therapy model, (...) on the other. CMT has been one of the most significant forces that helped shift cognitive science toward an embodied approach to cognition. While it has succeeded to place physical experience back where it belongs in reason and meaning, CMT has, however, also fallen into some positivist traps which lead to problems such as a dualism, a split between the knower and the known, and with that, to a distrust of introspective, first-person accounts. In the process of finding conceptual metaphors — generalizations that govern metaphorical expressions — CMT often deletes the idiosyncratic characteristics and presuppositions implicit in linguistic metaphors; it divorces them from people’s sensory experiences, the “here and now” and the intent of their communications. The constructivist approach to metaphor that I present here accepts as a priori assumptions much of what workers of CMT are out to prove. In particular, it takes the correlation of conceptual metaphors and physical experience, as well as the unity of language and thought as pragmatic givens. Emulating the constructivist therapist’s approach to metaphors, I show how it is possible to deconstruct conceptual metaphors into minute sensory distinctions, using one’s own person as the main tool, for the purpose of helping people change their experiences in desired ways, at will. I illustrate this process by numerous examples from a wide field of applications, including mathematics education and psychotherapy. (shrink)

A continuing challenge for researchers and practitioners alike is the lack of data on the effectiveness of corporate–community investment programmes. The focus of this article is on the minerals industry, where companies currently face the challenge of matching corporate drivers for strategic partnership with community needs for programmes that contribute to local and regional sustainability. While many global mining companies advocate a strategic approach to partnerships, there is no evidence currently available that suggests companies are monitoring these partnerships to see (...) if they do, in fact, represent ‘strategic’ investments. This article argues that applying the management concept of ‘investment performance’ to corporate–community partnerships requires questioning traditional evaluation methods that focus on the results of programmes or activities. We adopt a case study approach to introduce an evaluation framework that considers performance from both corporate and community perspectives and that conceptualises partnership performance as comprising four aspects: (1) the contribution of the partnership to the overall portfolio of a company’s community investment programmes, (2) the appropriateness of the partnership model, (3) the effectiveness of the partnering relationship and (4) the ability of the partners to achieve programme goals. The application of this evaluation framework to an established corporate–community partnership programme provided some useful insights as to how partnership performance can be improved. (shrink)

Recent thinking within philosophy of mind about the ways cognition can extend has yet to be integrated with philosophical theories of emotion, which give cognition a central role. We carve out new ground at the intersection of these areas and, in doing so, defend what we call the extended emotion thesis: the claim that some emotions can extend beyond skin and skull to parts of the external world.

Our aim is to provide a topography of the relevant philosophical terrain with regard to the possible ways in which knowledge can be conceived of as extended. We begin by charting the different types of internalist and externalist proposals within epistemology, and we critically examine the different formulations of the epistemic internalism/externalism debate they lead to. Next, we turn to the internalism/externalism distinction within philosophy of mind and cognitive science. In light of the above dividing lines, we then examine first (...) the extent to which content externalism is compatible with epistemic externalism; second, whether active externalism entails epistemic externalism; and third whether there are varieties of epistemic externalism that are better suited to accommodate active externalism. Finally, we examine whether the combination of epistemic and cognitive externalism is necessary for epistemology and we comment on the potential ramifications of this move for social epistemology and philosophy of science. This article explores the implicit theories of morality, or the conceptions regarding the patterns of stability, continuity and change in moral dispositions, both in lay and academic discourses. The controversies surrounding these conceptions and the fragmentation of the models and perspectives in metaethics and moral psychology endangers the pursuit of adequate operationalizations of morally relevant constructs. The current debate between situationists, who deny that character is an useful concept for understanding human behavior, which is better explained by contextual factors (Doris (...) 1998; Harman 1998) and dispositionists, who advocate the cross-situational stability of traits, is also present in the lay discourse, through the existence of competing commonsense ontological assumptions regarding the mutability or alterability of moral features, namely the implicit theories perspective (Chiu, Dweck, Tong, & Fu 1997). These personal theories are primary suspects in the affective and cognitive reactions to transgressions: the type of attended information in formulating evaluative judgments, the calibration of moral responsibility and blameworthiness, the assignment of retribution or reparatory recommendations to transgressors. In the second part of the study we attempt to advance toward a more fine-grained inspection of these lay beliefs, arguing that the construct of implicit theories of morality, as it is currently treated and measured, tends to be restrictive and oversimplifying. [ES] El presente artículo estudia el influjo de los tratados físicos de Aristóteles sobre la concepción tomista en torno al lugar del infinito en el cosmos creado. Se analiza la posición sostenida por el Aquinate respecto a cuatro aspectos fundamentales de la teoría aristotélica en torno al infinito: existencia de una sustancia infinita, existencia de un cuerpo infinito, existencia de un infinito en acto y la infinitud del tiempo. Asimismo se expone el empleo de la teoría aristotélica del movimiento y (...) los lugares naturales, por parte del Doctor angélico, para la refutación de toda posición que conciba el acto de creación como una mutación temporalmente sucesiva, así como su caracterización de la divinidad como sustancia perfecta cuya infinitud no puede ser comprendida bajo la noción de cantidad. [EN] This article studies the influence of Aristotle’s physical treatises on the Thomist conception on the place of infinity in the created cosmos. It analizes the position held by Aquinas on four fundamental aspects of the Aristotelian theory about infinity: existence of an infinite substance, existence of an infinite body, existence of an infinite in act and the infinity of time. Is also exposed the use of the Aristotelian theory of motion and natural places by the Angelic Doctor for the refutation of every position that presents the act of creation as a temporally successive mutation and his characterization of divinity as a perfect substance whose infinity can not be understood under the notion of quantity. Rules are meant to apply equally to all within their jurisdiction. However, some rules are frequently broken without consequence for most. These rules are only occasionally enforced, often at the discretion of a third-party observer. We propose that these rules—whose violations are frequent, and enforcement is rare—constitute a unique subclass of explicitly codified rules, which we call ‘phantom rules’ (e.g., proscribing jaywalking). Their apparent punishability is ambiguous and particularly susceptible to third-party motives. Across six experiments, (N = 1440) we validated (...) the existence of phantom rules and found evidence for their motivated enforcement. First, people played a modified Dictator Game with a novel frequently broken and rarely enforced rule (i.e., a phantom rule). People enforced this rule more often when the “dictator” was selfish (vs. fair) even though the rule only proscribed fractional offers (not selfishness). Then we turned to third person judgments of the U.S. legal system. We found these violations are recognizable to participants as both illegal and commonplace (Experiment 2), differentiable from violations of prototypical laws (Experiments 3) and enforced in a motivated way (Experiments 4a and 4b). Phantom rule violations (but not prototypical legal violations) are seen as more justifiably punished when the rule violator has also violated a social norm (vs. rule violation alone)—unless the motivation to punish has been satiated (Experiment 5). Phantom rules are frequently broken, codified rules. Consequently, their apparent punishability is ambiguous, and their enforcement is particularly susceptible to third party motives. (shrink)

any of us think that we have duties of distributive justice towards our fellow citizens that we do not have towards foreigners. Is that thought justified? This paper considers the nature of the state's relationship to distributive justice from the perspective of utilitarianism, a theory that is barely represented in contemporary philosophical debates on this question. My strategy is to mount a utilitarian case for state-specific duties of distributive justice that is similar in its basic structure to the one that (...) is standardly mounted for special duties towards the near and dear. I begin with a discussion of whether or not the co-citizen relationship can be justified in terms of its welfare consequences. I then consider what the answer to that first question implies concerning the duties of distributive justice that arise within that relationship. (shrink)

This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. En esta modernización y cambios permanentes, los museos necesitan aplicar calidad en su gestión incorporando criterios de control y evaluación para obtener los mejores resultados. El desarrollo del presente trabajo estará enfocado en el análisis de la gestión de calidad en las instituciones museísticas. Considerando que los modelos de calidad son un referente de la gestión, la investigación estará dirigida a la determinación de si es aplicable el modelo iberoamericano de gestión en los museos. Este modelo de excelencia en gestión (...) fue desarrollado a partir de la iniciativa de la Fundación Iberoamericana para la Gestión de la Calidad (Fundibeq) y reúne la opinión de países de América y Europa. Constituye una guía que posibilita a las organizaciones medir el grado de avance respecto a las variables que integran el modelo y, en ese marco, definir acciones que permitan cubrir la brecha entre el modelo y la realidad organizacional. La investigación se enfoca en analizar su aplicabilidad a los museos como unidades complejas, con misiones específicas, en proceso de importante transformación cualitativa y la medida que contribuye a enriquecer su gestión. Para ello se realizó en una primera instancia una revisión bibliográfica respecto de la concepción de museo, calidad y gestión organizacional. Posteriormente, se efectuó la investigación sobre la base de entrevistas a los directores de los museos seleccionados. Desde el punto de vista metodológico formal –para la elección de la muestra y siguiendo a Dillon – se usó un tipo de muestreo no probabilístico denominado muestra de criterio que consiste en la selección de determinados encuestados para que participen en el estudio. La selección busca satisfacer las necesidades concretas de la investigación para lo que se incluyeron en la muestra los principales museos montevideanos públicos y privados que representan 27% del total. El trabajo se divide en cuatro apartados. El primero muestra una revisión de la bibliografía al respecto de la gestión y su aplicabilidad en los museos y, en el segundo, se presentan distintos modelos de gestión de calidad haciendo hincapié en el modelo iberoamericano de gestión. En la tercera parte del trabajo se desarrolla la investigación empírica y en la cuarta se exponen las conclusiones de la investigación. (shrink)

In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras.
